1. About these Terms

These Terms & Conditions ("Terms") govern access to and use of the MultiBooking platform, websites, web applications, mobile applications, booking interfaces and related services (collectively, the "Platform").

MultiBooking is operated by Serhii Miroshnyk, operating under the name MultiBooking, at Hviezdoslavov, Slovakia ("MultiBooking", "we", "us", or "our").

By creating an account, accessing the Platform, or using the Platform to create or manage a booking, you agree to these Terms.

If you use MultiBooking on behalf of a business or other organisation, you represent that you have authority to act on its behalf.

2. What MultiBooking does

MultiBooking provides software that helps businesses manage services, employees, schedules, customers and bookings.

Customers may use MultiBooking to discover participating businesses and services, make and manage bookings, and interact with businesses through available booking interfaces.

Bookings may also be created or managed by authorised Business personnel on behalf of Customers.

MultiBooking is a technology platform. We do not provide the services offered by Businesses through the Platform.

The Business providing a booked service is solely responsible for that service and for its professional, regulatory, licensing, safety and consumer-law obligations.

3. Definitions

Business means a person, sole trader, company or other organisation using MultiBooking to offer or manage services.

Business User means an owner, administrator, manager, employee or other authorised person accessing a Business account.

Customer means a person whose booking or customer information is processed through MultiBooking.

Booking means an appointment or reservation for a service offered by a Business.

Content means information, text, images, descriptions, customer information, service information or other materials submitted to the Platform.

4. Eligibility and minors

Business accounts may only be created or controlled by persons aged 18 or older who have legal authority to act for the relevant Business.

Customer accounts are intended for persons aged 16 or older.

Persons under 16 should use Customer-facing booking functionality only with the involvement and authorisation of a parent or legal guardian where required by applicable law.

Businesses remain responsible for determining whether they may lawfully provide their particular services to minors and whether parental or guardian consent is required.

The Platform is not specifically directed to children.

5. Business accounts

Businesses must provide accurate and current information when creating and maintaining an account.

Businesses are responsible for:

  • maintaining the confidentiality and security of their account credentials;
  • controlling access granted to owners, administrators, managers and employees;
  • keeping their services, prices, durations, availability and other Business information accurate;
  • configuring employee schedules and availability correctly;
  • ensuring that Business Users have appropriate authority to access Customer information;
  • complying with laws applicable to their activities and services;
  • maintaining any licences, professional qualifications, permits or insurance required for their activities.

A Business is responsible for activity performed through its account unless it has notified MultiBooking of unauthorised access without unreasonable delay.

6. Customer accounts and guest bookings

Where supported, Customers may use MultiBooking with a registered Customer account or through booking interfaces that do not require a permanent Customer account.

Customers must provide accurate information required to create and manage their Bookings.

Customers are responsible for maintaining the confidentiality of their account credentials where an account is used.

A Customer must not create fraudulent, misleading or intentionally disruptive Bookings.

7. Bookings

A Booking created through MultiBooking represents a request for or confirmation of an appointment with the relevant Business, depending on the booking method configured by that Business.

The Business may determine:

  • available services;
  • available employees;
  • appointment duration;
  • available times;
  • cancellation conditions;
  • rescheduling conditions;
  • late-arrival policies;
  • no-show policies; and
  • other service-specific conditions.

MultiBooking provides the technical infrastructure used to create and manage the Booking but is not the provider of the booked service.

The contractual relationship regarding the actual service is between the Customer and the Business.

8. Bookings created by Businesses

Authorised Business Users may create, modify or cancel Bookings on behalf of Customers.

When a Business User enters Customer information into MultiBooking, the Business is responsible for ensuring that it has a lawful basis to collect and use that information and to provide it to MultiBooking.

Businesses must not use MultiBooking to create fictitious Customer records or to process Customer data for purposes unrelated to legitimate Business operations.

9. Prices and payments for Business services

Businesses are responsible for displaying accurate service prices where prices are displayed through the Platform.

MultiBooking does not currently collect, hold, process or mediate payments between Customers and Businesses.

Any payment for a booked service takes place directly between the Customer and the Business using arrangements determined by the Business.

MultiBooking is not responsible for payment disputes, refunds, chargebacks or financial transactions between Customers and Businesses.

If MultiBooking introduces payment functionality in the future, the applicable Terms and Privacy Policy will be updated before that functionality is made available.

10. MultiBooking fees

During the current introductory period, MultiBooking may provide some or all Business functionality without subscription fees.

We may introduce paid plans or paid functionality in the future.

A Business will not be charged a new subscription fee without being informed of the applicable price and payment terms in advance and, where required, accepting those terms.

11. Cancellations, rescheduling and no-shows

Businesses may establish their own policies regarding cancellations, rescheduling, late arrivals and no-shows.

Where such policies are displayed through MultiBooking, Customers should review them before making a Booking.

MultiBooking does not independently impose cancellation charges or no-show charges on Customers.

Any dispute concerning the delivery, cancellation, quality or price of a Business service should normally be resolved between the Customer and the Business.

12. Business information and Content

Businesses may upload or provide Content including Business descriptions, service information, employee information, logos, photographs and other materials.

Businesses retain ownership of their Content.

By submitting Content to MultiBooking, the Business grants MultiBooking a non-exclusive, worldwide, royalty-free licence to host, reproduce, resize, transmit and display that Content solely as reasonably necessary to operate, secure and promote the Business through the Platform.

The Business represents that it has the rights necessary to provide such Content.

13. Prohibited use

You must not use MultiBooking to:

  • violate applicable law;
  • impersonate another person or Business;
  • access another user's account without authorisation;
  • interfere with the operation or security of the Platform;
  • introduce malware or malicious code;
  • scrape or systematically extract Platform data without authorisation;
  • send spam or unsolicited communications;
  • create fraudulent Bookings;
  • obtain Customer data for unrelated purposes;
  • upload unlawful or infringing Content;
  • attempt to reverse engineer or circumvent security controls except where expressly permitted by law.

14. Personal data

Use of personal data through the Platform is governed by our Privacy Policy.

Where MultiBooking processes personal data on behalf of a Business, such processing is also governed by our Data Processing Agreement.

Each Business remains responsible for its own obligations as a data controller in relation to its Customers and employees.

15. Third-party services

MultiBooking relies on third-party infrastructure and technology providers to operate the Platform.

These may include hosting, network, content-delivery, media-storage, email and mobile-notification providers.

Third-party services may occasionally experience interruptions outside MultiBooking's reasonable control.

16. Platform availability and changes

We aim to provide a reliable Platform but do not guarantee uninterrupted or error-free operation.

We may perform maintenance, deploy updates, modify features or temporarily restrict access where reasonably necessary for security, maintenance or technical reasons.

We may add, modify or discontinue features as the Platform develops.

Where a material change significantly affects Business use of the Platform, we will make reasonable efforts to provide advance notice when practicable.

17. Intellectual property

The MultiBooking software, user interface, branding, documentation and other Platform materials, excluding Content supplied by users, are owned by or licensed to MultiBooking and are protected by applicable intellectual-property laws.

These Terms do not transfer any ownership of MultiBooking intellectual property to users.

18. Suspension and termination

We may suspend or restrict access where reasonably necessary because of:

  • a material breach of these Terms;
  • unlawful activity;
  • security risks;
  • fraudulent or abusive use;
  • risk to other Platform users or infrastructure; or
  • a legal or regulatory requirement.

Where appropriate, we will provide notice and an opportunity to remedy the issue.

Businesses and Customers may stop using the Platform and may request account deletion subject to applicable retention obligations.

19. Disclaimer regarding Business services

MultiBooking does not control the professional performance of Businesses.

We do not guarantee:

  • the quality or suitability of a Business's services;
  • the accuracy of all information supplied by a Business;
  • that a particular Business or employee will fulfil a Booking;
  • that a Customer will attend a Booking;
  • any particular outcome from a booked service.

Nothing in these Terms limits rights that cannot lawfully be excluded.

20. Limitation of liability

To the maximum extent permitted by applicable law, MultiBooking will not be liable for indirect or consequential losses arising solely from the acts or omissions of a Business or Customer, including disputes concerning the quality, price or performance of a booked service.

For Business users, MultiBooking will not be liable for loss of profit, loss of anticipated revenue or indirect commercial loss except where such liability cannot lawfully be excluded.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law, including liability arising from fraud, intentional misconduct, or other liability that applicable law requires to remain unlimited.

Mandatory consumer rights are not affected by these Terms.

21. Termination by MultiBooking

We may discontinue the Platform or terminate an account where reasonably necessary.

Where practicable, Businesses will be provided reasonable notice of a general discontinuation of the Platform and an opportunity to retrieve relevant data.

Immediate termination may occur where necessary to address fraud, serious security risks, unlawful conduct or legal requirements.

22. Changes to these Terms

We may update these Terms to reflect:

  • changes to the Platform;
  • new functionality;
  • legal or regulatory requirements;
  • security requirements; or
  • changes to our business model.

The current version will be published on the MultiBooking website with its effective date.

Material changes affecting registered users will be communicated where reasonably appropriate.

23. Governing law

These Terms are governed by the laws of the Slovak Republic, without prejudice to mandatory protections available to consumers under the laws applicable to them.

Nothing in these Terms deprives an EU consumer of mandatory consumer protections that cannot lawfully be excluded by contract.
